By engaging with HR Ambulance, you acknowledge and agree to the following terms:
1. Confidentiality & Non-Disclosure
All information, documents, communications, emails, chat messages, and discussions shared with us are treated as strictly confidential and privileged. Such information shall not be disclosed, shared, reproduced, or distributed to any third party without prior written consent, except where required by applicable law.
2. Purpose Limitation
Information shared with us will be used solely for the purpose of providing HR advisory support and resolving your specific query. It will not be used for marketing, publication, benchmarking, training datasets (external), or any unrelated purpose.
3. Data Security & Safeguarding
We implement reasonable administrative, technical, and organizational safeguards to protect all confidential information against unauthorized access, misuse, or disclosure. Access is strictly limited to authorized personnel on a need-to-know basis.
4. Third-Party Access / Sub-Processors
Confidential information may be accessed by internal team members or authorized consultants strictly for service delivery purposes. Where required, secure third-party tools (such as email platforms, Zoom, or workflow systems) may be used, subject to confidentiality obligations.
5. Advisory Nature of Services
All guidance, recommendations, and outputs provided are purely consultative in nature and are based on the information shared by the client. They do not constitute legal, statutory, regulatory, or binding HR advice unless explicitly confirmed in writing by an authorized representative. No consultant-client fiduciary relationship is created unless expressly agreed.
6. Information Accuracy
Our advisory is dependent on the completeness and accuracy of the information provided by you. Any incomplete, inaccurate, or misleading information may impact the relevance and accuracy of the guidance shared.
7. No Warranty & Limitation of Liability
All guidance is provided in good faith and on a best-effort basis. No warranties are made regarding completeness, accuracy, or outcomes. HR Ambulance shall not be held liable for any direct, indirect, incidental, or consequential outcomes arising from decisions taken based on the advisory provided.
8. Indemnity
You agree that HR Ambulance shall not be held responsible for any claims, losses, damages, or liabilities arising from:
- Inaccurate or incomplete information provided by you
- Decisions or actions taken based on advisory outputs
- Misuse of information or recommendations shared
9. Intellectual Property
All frameworks, templates, methodologies, insights, and deliverables shared remain the intellectual property of HR Ambulance unless explicitly transferred in writing. These materials are provided solely for internal use and may not be copied, reproduced, distributed, or commercially used without permission.
10. Call Recording & Consent
Virtual consultations (including Zoom calls, Google Meet, or similar platforms) may be recorded for quality assurance, training, and documentation purposes. By participating, you provide explicit and informed consent for such recording.
11. Data Retention & Deletion
Information shared with us will be retained only for as long as necessary to provide services or comply with applicable legal or operational requirements. After this period, data may be securely deleted or anonymized.
12. Communication Consent Scope
By engaging with us, you consent to receive communication via email, phone, WhatsApp, or other official channels strictly related to your query or service delivery.
13. Continuing Effect
These terms remain valid during the engagement and continue to apply even after completion of services.
14. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts located at Mumbai, Maharashtra, India.
15. Privacy & Data Protection
HR Ambulance shall process personal information in accordance with applicable data protection and privacy laws. By engaging with our services, you consent to the collection, storage, processing, and use of your information solely for providing the requested services and fulfilling legal or contractual obligations.
16. Force Majeure
HR Ambulance shall not be liable for any delay or failure in performing its obligations due to events beyond its reasonable control, including but not limited to natural disasters, internet outages, cyber incidents, governmental actions, pandemics, or other force majeure events.
17. Right to Refuse or Discontinue Services
HR Ambulance reserves the right to decline, suspend, or discontinue advisory services where information provided is false, misleading, unlawful, abusive, or where continuation of services would violate applicable laws, professional standards, or internal policies.
